ISO COMMERCIAL CRIME COVERAGE FORMS AND POLICIES DECLARATIONS

INTRODUCTION

The Insurance Services Office (ISO) developed several advisory declarations for use with the various ISO Commercial Crime Coverage Forms and Government Crime Coverage Forms. Most insurance companies modify them to meet their specific needs. This article has been updated to reflect the 06 22 edition of the Declaration. Changes will be highlighted in bold.

There are eight different declarations:

The following analyses are of the ISO advisory CR DS 01–Crime and Fidelity Coverage Part Declarations (Commercial Entitles) and CR DS 02–Commercial Crime Policy Declarations.

CR DS 01–CRIME AND FIDELITY COVERAGE PART DECLARATIONS (COMMERCIAL ENTITIES)

(06 22 edition)

With the 06 22 edition, this Declaration no longer has a header, which means the “Coverage Is Written” and selection options are no longer needed.

The Employee Benefit Plan name has been replaced with the Named Insured.

Insuring Agreements, Limits of Insurance, and Deductible Amounts

(06 22 edition)

The Insuring Agreement statement has been moved to the top and updated to clarify that coverage is provided only if an amount is specified in the Limit of Insurance Per Occurrence. If the limit is left blank or marked as “not covered,” coverage is excluded.

The next section provides spaces to enter the insurance limits for each coverage section per occurrence and the deductible amounts per occurrence for the following Insuring Agreements:

1. Fidelity

In the 06 22 edition, numbers and letters have been added to the Insuring Agreement Sections due to the addition of Fidelity. The following are all new sections to the Fidelity Insuring Agreement.

a.      Employee Theft

b.      ERISA Plan Official Dishonesty (Deductible Amount Per Occurrence does not apply)

c.      Employee Theft Of Clients’ Property

2. Forgery or Alteration

In the 06 22 edition, Numbers and letters have been added to the Insurance Agreement Section due to the splitting of coverage for Forgery or Alteration. The below are new sections to the Forgery or Alterations Insuring Agreement.  

a.      Forgery of Negotiable Instruments

b.      Forgery of Payment Card Instruments (Deductible Amount Per Occurrence does not apply)

The following items are not new but are numbered instead of using small alphabet characters in the 06 22 edition.

3. Inside the Premises–Theft of Money and Securities

4. Inside the Premises–Robbery or Safe Burglary of Other Property

5. Outside the Premises

6. Computer and Funds Transfer Fraud

7. Fraudulent Impersonation

8. Money Orders and Counterfeit Money

This section has spaces to enter the following:

Cancellation of Prior Insurance by Us

This unique part of the declarations requires the listing of prior crime policies issued by this insurance company for the named insured. When the named insured accepts this policy, those prior policies are canceled as of the effective date of this policy.

Counter Signature has been removed from the form with the 06 22 edition.

CR DS 02–COMMERCIAL CRIME POLICY DECLARATIONS

(06 22 edition)

With the 06 22 edition, this Declaration no longer has a header, which means the “Coverage Is Written” and selection options are no longer needed.

The beginning sections of the declarations are as follows:

DIFFERENCES BETWEEN THE TWO DECLARATIONS

CR DS 02–Commercial Crime Policy Declarations is the same as CR DS 01–Crime And Fidelity Coverage Part Declarations, except that the information usually found on the Common Policy Declarations has been moved to the Crime Policy Declarations.
